Mediation VS. Litigation
Mediation is based off a zero-sum principle. It provides those in conflict autonomy in a non-adversarial manner. Mediation is a faster, more cost-effective way to resolve disputes in a manner both parties are amenable to.
Both mediation and litigation provide routes to resolve a dispute. The results for both are enforceable and recognized by the courts.
Litigation is often thought of as the default in resolving disputes. It provides the structure of the legal system while pitting the parties against one another and creating a win-lose dichotomy.
